Introduction

We at Motorola Mobility India Private Limited (CIN: U32204KA2009PTC112722), having our registered office at Bagmane Tech Park, No. 66/1, Plot No. 5, 5th Floor, C.V. Raman Nagar, Bangalore, Karnataka 560093, India (hereinafter referred to as "Motorola", "we", "us" or "our"), place great importance on the privacy and security of your personal information ("Personal Data"). We want you to feel safe using our mobile application, the Motorollers App ("Platform").

The Platform is a community application for owners, fans and followers of Motorola devices in India. It allows users to share posts, articles and polls, join groups, and take part in events and contests (collectively, "Services").

Motorola is the Data Fiduciary for your Personal Data under the Digital Personal Data Protection Act, 2023 ("DPDP Act"). The Platform is developed and operated on our behalf by our technology partner, The Marcom Avenue, which acts as our Data Processor and processes your Personal Data only on our instructions.

This Privacy Policy explains how we collect, use, share, store and protect your Personal Data when you use the Platform, and the rights you have in relation to it. Please read it carefully before using the Platform.

By creating an account on and using our Platform, you acknowledge that you have read and understood this Privacy Policy and consent to the processing of your Personal Data in accordance with it, our Terms of Use and our Terms and Conditions.

I. What Data Is Collected

We collect only the Personal Data we need to provide the Services. Mandatory fields are marked in the Platform. If you choose not to provide optional information, you can still use the Platform, although some features may be limited.

1. Personal Data

  1. Account Creation. To use the Platform, you must create an account ("Account") using your mobile number, which is mandatory and is verified through a one-time password ("OTP"). You may choose to add your name, email address, city, language preference and a profile photo to your user profile ("Profile").
  2. Login Data. The OTP sent to you is stored only in encrypted form and expires within five (5) minutes. A session token is created to keep you signed in.
  3. Content You Share. Posts, articles, poll responses, comments, reactions, photos and videos you upload to the Platform.
  4. Contest Winner Details. If you win a contest, we may ask for your name and delivery address to send you the prize, and your PAN where required by law for tax deduction on the prize.
  5. Support and Moderation Data. Messages you send us, reports you file or that are filed about your content, moderation decisions and appeals.

2. Usage Data

  1. Activity Data. Groups you join, content you view or react to, events and contests you take part in, and the date and time of your activity.
  2. Device and Log Data. Device model, operating system and Platform version, IP address, and crash and error logs.
  3. Notification Data. A push notification token for your device, if you allow notifications.

3. Data We Do Not Collect

We do not collect your IMEI or hardware serial number, precise location, contacts, call logs, SMS content, biometric data, bank, card or UPI details, or any government identity document, except the PAN of contest winners where required by law. We do not collect any health or financial information.

II. When and How Personal Data Is Collected

  1. Directly from you, when you register, complete your Profile, post content or contact us.
  2. Automatically, when you use the Platform, through your device and your interactions with the Platform.
  3. From other members and our moderators, when content is reported or moderated.
  4. When you take part in contests, events or campaigns.

III. How We Use Your Personal Data

a) Personal Data

We use your Personal Data, on the basis of your consent unless stated otherwise, for the following purposes:

  1. Creating, verifying and securing your Account.
  2. Displaying your Profile and content to other members, and running groups, polls, events and contests.
  3. Running contests and campaigns, selecting winners and delivering prizes.
  4. Sending service messages such as OTPs, security alerts, moderation decisions and contest results.
  5. Sending promotional messages about Motorola products, offers and community campaigns, only where you have separately opted in.
  6. Moderating content and detecting and preventing spam, fraud, abuse and security incidents.
  7. Troubleshooting problems, maintaining security and improving the Platform.
  8. Complying with applicable law, court orders and lawful requests from government authorities.

We do not sell your Personal Data, and we do not use it for third-party advertising. We may use aggregated or anonymised data, which cannot identify you, to understand how the community uses the Platform.

Some moderation checks are automated. For example, posts containing certain keywords may be held for review. Decisions to suspend or ban an Account are taken by a person and not by an automated system alone.

b) Disclosure to Third Parties

We share Personal Data only with the service providers listed below, who process it on our behalf under contract and only for the purposes stated:

  1. Amazon Web Services India Private Limited: cloud hosting and storage of Platform data, in India.
  2. Gupshup Technology India Private Limited: delivery of OTPs and service messages by SMS and WhatsApp, using your mobile number and the message content.
  3. Google LLC (Firebase Cloud Messaging): delivery of push notifications, using your device notification token and the notification content.
  4. Email service providers: delivery of service emails, using your email address and the message content.
  5. Prize fulfilment partners: delivery of contest prizes, using only the details needed, such as your name, mobile number and delivery address.
  6. The Marcom Avenue: development, operation and support of the Platform.

Content you post publicly on the Platform, together with your display name and profile photo, is visible to other members. Please do not include personal details in public posts that you do not want others to see.

We may also disclose your Personal Data, without prior notice, where required to comply with any law, court order or lawful request from a government or statutory authority, to enforce our Terms of Use, or to protect the rights, property or safety of our members, Motorola or the public. If we or our business are merged with or acquired by another entity, your Personal Data may be transferred to that entity, which will remain bound by this Privacy Policy.

If we need to share your Personal Data for any purpose not described above, we will ask for your consent first.

c) Where Your Data Is Stored

Your Personal Data is stored on secure servers located in India (AWS Mumbai region). Device notification tokens and notification content are processed by Google Firebase outside India solely to deliver push notifications. Any transfer of Personal Data outside India is made only to countries not restricted by the Government of India under the DPDP Act.

IV. How Long We Retain Your Data

  1. OTPs are retained for up to five (5) minutes.
  2. Account, Profile, content and activity data are retained while your Account is active, and deleted within thirty (30) days of Account deletion. Backup copies are overwritten within a further thirty-five (35) days.
  3. Push notification tokens are retained until you log out, uninstall the Platform or disable notifications.
  4. Server, security and audit logs, and moderation records, are retained for up to one hundred and eighty (180) days, or longer where required by law or for an ongoing dispute or investigation.

V. Your Privacy Controls

  1. Platform. When signed in, you can review and update your Profile details, and manage your notification and promotional message preferences, from the settings in the Platform.
  2. Device-level settings. Your device settings allow you to control push notifications and the permissions granted to the Platform.
  3. Withdrawal of consent. You may withdraw your consent at any time from the settings in the Platform or by writing to the Grievance Officer. Withdrawing consent is as easy as giving it. If you withdraw consent for data needed to run your Account, we will not be able to continue providing the Services, and your Account will be closed. Withdrawal does not affect processing carried out before it.

VI. How We Keep Your Data Secure

a) Security Precautions

We have implemented reasonable physical, administrative and technical safeguards to protect your Personal Data from unauthorised access, use and disclosure, including:

  1. Storing Personal Data on secure cloud servers in a private network, protected by a web application firewall.
  2. Encrypting all Personal Data in transit using TLS and at rest.
  3. Storing OTPs only in encrypted form, with expiry within five (5) minutes.
  4. Role-based access controls that limit access to Personal Data to authorised personnel on a need-to-know basis, with all administrative actions logged.
  5. Granting engineering access to live data only through an approved, time-limited and logged process.
  6. Independent vulnerability assessment and penetration testing of the Platform before launch and at regular intervals.
  7. An incident response process to respond quickly to any suspected breach of Personal Data. If a breach affects you, we will inform you and the Data Protection Board of India as required by law.

While we take all reasonable steps to protect your Personal Data, no method of transmission over the internet or electronic storage is completely secure. You are responsible for keeping your device and OTPs secure. If you believe your Account has been accessed without your permission, please contact us immediately at support@motorollers.in.

b) Third-Party Links

The Platform may contain links to third-party websites or services that are not operated by us. We are not responsible for the privacy practices or content of those websites or services. Please review their privacy policies before providing any information to them.

VII. Children

The Platform is only for persons aged eighteen (18) years or older. We do not knowingly collect Personal Data from anyone under 18. If we learn that a person under 18 has registered, we will close the Account and delete the related Personal Data. If you believe that a child is using the Platform, please contact the Grievance Officer.

VIII. Your Rights

In accordance with the DPDP Act, you have the right to:

  1. obtain a summary of the Personal Data we hold about you, the processing activities carried out, and the identities of those with whom it has been shared;
  2. correct, complete, update or erase your Personal Data;
  3. withdraw your consent at any time;
  4. have your grievances addressed by our Grievance Officer; and
  5. nominate another person to exercise your rights in the event of your death or incapacity.

To exercise any of these rights, please write to the Grievance Officer. We will verify your identity before processing your request and respond within the time required by applicable law. If you are not satisfied with our response, you may file a complaint with the Data Protection Board of India.

IX. Account Deletion

You may delete your Account at any time:

  1. in the Platform, from Profile > Settings > Delete Account; or
  2. on the web, without logging in to the Platform, at motorollers.in/delete-account.

We will verify the request through an OTP sent to your registered mobile number. Once your Account is deleted:

  1. your Profile and Personal Data will be deleted within the periods set out in Section IV;
  2. your posts and comments will be deleted or, where they form part of another member's discussion, shown as "Deleted member" with no link to you. You may delete individual posts before closing your Account;
  3. we may retain limited records where required by law, to resolve a dispute, or to prevent fraud or ban evasion, as set out in Section IV.

X. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you in the Platform before any material change takes effect and, where required, ask for your consent again. The "Last updated" date at the top of this page shows when this Privacy Policy was last revised.

XI. Terms of Use and Terms and Conditions

Your use of the Platform is also governed by our Terms of Use and Terms and Conditions. Please read this Privacy Policy together with them.
